The Case Was Not Over

Why Louboutin Shoes Are So Expensive | So Expensive

Let off the hook, so to speak, because its shoes namely, its;Tribute, Tribute, Tribtoo, Palais, and Woodstock styles consist of an all-over red body complete with a red sole, YSLs counsel, prominent New York-based litigator David Bernstein of Debevoise;& Plimpton, claimed victory, as well, telling the press, The Court has conclusively ruled that YSLs monochromatic red shoes do not infringe any trademark rights of Louboutin, which guarantees that YSL can continue to make monochromatic shoes in a wide variety of colors, including red. ;;

The case was not over, though. Still up for debate as of January 2013 was the actual language of the trademark registration for Louboutins red sole, as in limiting of the breadth of Louboutins trademark rights from the sweeping;lacquered red sole on footwear to a red sole on a contrasting colored shoe, the Second Circuit ordered that the USPTO modify the language of Louboutins trademark registration.

Ultimately, the language would be determined to read as follows: a red lacquered outsole on footwear that contrasts with the color of the adjoining portion of the shoe.

On one hand, the validity of the famed footwear brands trademark has been upheld by a series of important decisions, including ones from the Paris Court of Appeal, the Court of Justice for the European Union, the Hanseatic Court of Appeals in Germany,;the Beijing High Court, and the European Union Intellectual Property Office, among others.

Applying Public To Your Business

So think about your own business or brand. How can you apply the built to show, built to grow mentality? Is there some type of visual you can attach to your products to make them unmistakable, like the Christian Louboutins red soles? If you have a storefront, how can you turn your windows into a spectacle?

Louboutin Wins Legal Battle Over Red Soles

Europe’s highest court has backed Christian Louboutin in its battle to protect its distinctive red soles.

In 2012, Louboutin sued rival firm Van Haren for selling high heeled shoes with scarlet soles.

Under EU law companies cannot trademark common shapes of products such as the soles of shoes.

Van Haren argued that applying red to a shoe sole came under that law and, as a result, Louboutin did not have trademark protection.

However, the European Court of Justice said that shape trademarks do not apply to Louboutin’s red sole.

Christian Louboutin first designed his trademark shoe in 1993, using an assistant’s red nail polish.

The luxury brand said it “warmly welcomes” the judgement.

“For 26 years, the red sole has enabled the public to attribute the origin of the shoe to its creator, Christian Louboutin,” the brand said in a statement.

“This case will now be referred back to The Hague Court which is expected to confirm the validity of the red sole trademark.”

The Famous Christian Louboutin Red Sole

Without a doubt, the easiest way to tell is the red sole. The Louboutin red bottoms should be vibrant red, shiny leather, with a slight curve to the edges. Furthermore, it shouldnt be plastic, resin or flat. When worn, it will look like scruffed-up leather.

New Christian Louboutin shoes come with the leather sole. However, many people opt to get a rubber sole overlay to give grip. The vast majority of shoe repairers use Topy leather which has the Topy logo stamped across it. Christian Louboutins repairer in France, Minuit Moins 7 uses a Christian Louboutin stamped red rubber overlay sole.

At Baxter & Black, we use an Italian-made shiny red sole to match the rest of the shoe exactly. We use the same process as Louboutins repairer in France, Minuit Moins 7. The process involves lightly sanding down the original sole, before glueing the rubber overlay sole ontop. The edges are gently aligned with the original sole. Finally, the sole edges are touched up with matching paint. Our process has a much sleeker and thinner profile than using the Topy rubber overlay.

The True Story Of How Christian Louboutin Shoes Got Those Trademark Red Soles

One day I will have red soled shoes!!!

Christian Louboutin has been credited with making women’s legs look longer, creating celebrity high heel frenzies, inspiring serious lust and temporary credit card insanity in fashion editors like me, and perhaps most importantly, turning the once-overlooked sole of a shoe into a bona fide status symbol. So just how did his highly coveted cherry red soles come to be?

This week’s New Yorker has a funny and very telling profile on the shoe designer, and nestled among the many incredible anecdotes is the story of how those red bottoms became his signature.

Back in 1993 when he had been in business for about two years, “Louboutin had thought of making a shoe inspired by Andy Warhol’s ‘Flowers.’ The prototype, a pink stacked heel with a cartoonish cloth blossom, had arrived from Italy. ‘I was very happy, because it was similar to the drawing,’ Louboutin recalled, ‘but the drawing still was stronger and I could not understand why.’ Louboutin continued, ‘There was this big black sole, and then, thank God, there was this girl painting her nails at the time.’ Louboutin grabbed the nail polishit was redfrom the assistant and slathered it on the sole of the prototype. ‘Then it popped,’ he recalled, ‘and I thought, This is the drawing!'”

The Secret Science Behind Red Bottom Shoes

by Brianne Fleming | Oct 30, 2019 |

In my last podcast episode of Making the Brand, my guest Gina and I talked about what bloggers can learn from Sex and the City. One of the things we touched on was Carrie Bradshaws obsession with shoes, which really stems from Sarah Jessica Parkers real-life obsession with shoes.;

But on the show, Carrie has no problem dropping hundreds of dollars on designer shoes. I guess you can say shoes are her guilty pleasure. Throughout the entire series, Carrie and the other characters touch on some of their favorite luxury brands from Dolce & Gabbana, Chanel, Gucci, Manolo Blahnik, Dior, Fendi, Prada, etc.;

No pun intended here, but on the heels of that episode, I want to talk about another brand of heels that has become a huge part of popular culture, in large part thanks to Sex and the City. Im talking about what we know as red bottom shoes, which is a moniker for the real brand name, Christian Louboutin.;

What Earned Them The Title Red Bottom Shoes

Red bottom shoes are given their name because of their distinct red bottoms.

This is a unique design decision that was;implemented by Louboutin and has given the shoes their unique and iconic look.;

These heels are renowned for their;vibrant;red color, and the truth behind them is that this was a design choice;created on a complete whim.

The story goes that one day in the shop an employee was painting her nails red, and at complete random Louboutin decided to snatch up the nail polish and paint the bottoms of a prototype red.

This was the beginning of this perfect;visual that people are now clamoring to;obtain.

After the design decision was made, it began a point of legal contention regarding whether or not these shoes could be trademarked with their red sole as a design decision.

The details about this were debated ad nauseum among many, and in;the end it was decided that shoes that were not red and exhibited a red sole could be considered unique to Louboutins work.

While there have been more deliberations beyond this, it is generally accepted that only Louboutins are the true red bottom shoe.

Youve probably seen countless celebrities wear Christian Louboutin shoes from Taylor Swift, to Beyoncé, Jennifer Lopez, Meghan Markle, Selena Gomez, Blake Lively, Rihanna, and Katy Perry. And at a price point of $800 and up, theyve really become a status symbol.;

Speaking of Christian Louboutins high price point, you may recall this being referenced in Ariana Grandes song, 7 rings, which is all about lavish spending and luxury. In one of the lyrics, she says that happiness is the same price as red bottoms.

There are a ton of other references to red bottoms in pop culture. Jennifer Lopez has an entire song called Louboutins. Hip hop star, Trina, has a song called Long Heels Red Bottoms, Cardi B mentions them in her song Bodak Yellow, and they are prominently featured in the TV show, Breaking Bad.

So what is it about red bottoms that makes them so special? I personally dont own a pair and have never tried them on, but its fascinating to hear Christian Louboutin himself talk about how these heels make women feel. He says they completely change your body language and you feel this sense of confidence from head to toe. Christian Louboutin openly acknowledges the shoes high price point, yet I love that he stands behind it. Theyre certainly a premium product, but you also get what you pay for. These shoes are nothing short of quality.;

Not Just About A Red Sole

Reflecting on the case years later, Lewin describes it as one of the most interesting cases in my career because it crossed over from the law and business side to the consumer side. Not only did lawyers follow it, or business leaders and CEOs, but it caught the eye of the consumers. It was all over digital media, as well as the print media and television and radio around the world, whether it was because it was a dispute between two French designers, whether it was because it was a legal dispute, or because it involved high fashion with some salacious content like people calling each other names.

The press was relentless on this case and they followed it closely. Most of the talking heads on television routinely got it wrong, he recalls. So, we had to manage the message from the point of the client because either side could easily have won the legal fight but lost the public opinion fight, and, in doing so, especially from Louboutins point of view, it would have dramatically affected the business. So, we took extraordinary pains to both manage the message as well fight the case in court.

And the element of consumer attention was significant. It meant that the case was about more than just a red shoe sole. It was about consumer perception.

With the high-stakes nature of rights at play, and given that the world was watching closely for almost two years, according to Lewin, we and the case, itself became a game changer.

Where Does Red Bottoms Come From

Though Christian Louboutin had been designing shoes since the early 1980s, it was in 1993 when he had the inspiration for what became his signature;red bottoms.

Legend has it that one of his assistants was painting her nails red, which inspired Louboutin to bring the sole of his stiletto to life with a daring pop of red lacquer. And so, red soles were born as a synonym for;Louboutinsand an icon of haute couture, luxury, and wealth more generally.

Since at least the early 2000s, hip-hop artists dubbed these red bottoms,;a term which has since spread into popular culture. In hip-hop culture, red bottoms often figure as a way to tout ones wealth, as a par of Loubs cost hundreds of dollars on the low end.

In 2008,;Christian Louboutin registered the red soles as a patent, and in early 2011, he took Yves St. Laurent to court for designing an all-red shoeall red meaning, of course, that the soles were red, too.

Google searches for;red bottoms;spiked at the height of this legal battle, when;Louboutin appealed a lower court decision to allow YSL to continue producing the red shoes. It would be late 2012 before the case was settled, with the court deciding that shoes with red soles, when the rest of the shoe is any other color, are protected by;Louboutins trademark. The trademark, though, is still in court from a 2012 dispute with Dutch brand;Van Haren. These bloody shoes cant catch a break, it seems.

Why Is Louboutin So Expensive

Using the most exotic leather, embellishments, and silhouette ideas, Louboutin red soles are created keeping in mind its customers demands. The craftsmanship involves sketching, material selection, polishing, and finishing a long-drawn process of 30 steps which all add up to the price tag of the red soles.

What Is Up With The Pricing On These Shoes

As one would expect with any;kind of designer item, red bottom shoes are known for their seemingly ridiculous price point.

While these shoes are incredibly common among the rich and fashionable, the average person is unlikely to be able to justify the cost without exclusively eating ramen for a few months.

Red bottom shoes are known for starting around $700 and the pricing on this special kind of shoe climbs well into the thousands depending on what model you are looking at.

This makes them a blatant status symbol that is known for;being recognized on sight.

These shoes are without question a luxury item that most people can only afford to dream about, but we can still all continue to hope for an increase in pay so that we can cash in on this awesome look.

The pricing is partially driven by the cost of the shoes themselves according to Christian Louboutin, but as is the case with most anything, the true value comes from the brand itself.

These iconic shoes are desirable, which makes it easy for the company to charge just about anything for it.

Since the average target audience for these items isnt Jill from the local grocery store, the;designers know that whatever they charge for this item, someone will probably pay.
