LONDON Can you trademark a color?

The French shoe designer Christian Louboutin known for sky-high stiletto shoes with scarlet soles that can sell for upward of $1,000 has been trying to do so for years. Mr. Louboutin first grabbed his assistants red nail polish and applied it to the outsoles of a shoe a quarter-century ago. Since then, he has frequently declared the design element to be his recognizable signature, and argued it merits legal protection.

On Tuesday, the European Unions highest court dealt a blow to that effort.

Mr. Louboutin had filed a lawsuit in 2012 against Van Haren, a Dutch company whose retail outlets were selling affordably priced high-heeled womens shoes with red soles. Lawyers for Mr. Louboutin claimed that the shoes sold by Van Haren, part of its Fifth Avenue by Halle Berry line, infringed on his brands trademark for footwear. That trademark, registered in Belgium, the Netherlands and Luxembourg, referred to the color red applied to the sole of a shoe.

Van Haren had to temporarily stop making and selling the line of shoes, but the companys lawyers fought back and the case eventually made its way to the European Court of Justice.

Louboutin Wins Case To Trademark Signature Red

The European Unions highest court has ruled that designer Christian Louboutin can trademark his companys signature red-soled shoes.

CORNISH: And this week, thats what designer Christian Louboutin did in court. He won a legal case protecting those trademark red soles.

SHAPIRO: The European Court of Justice ruled that a Dutch company had infringed on the trademark by selling its own red-soled shoes.

SUSAN SCAFIDI: And the reason why this case had to go all the way to the Court of Justice of the European Union is that there was a question are those red soles a shape or are they a color?

SCAFIDI: It means that no other company can use red soles legitimately because the red soles are not just a cool, decorative element. They are a sign or a signifier of the Louboutin company.

Famous French shoe-designer Christian Louboutin is the man behind the sexy, sky-high, signature red-soled shoes, which have been seen on the feet of superstars including Angelina Jolie, Scarlett Johannson and Jennifer Lopez . Even Barbie dolls have their own custom mini-sized Louboutins.

This month, Louboutin celebrates his 20th anniversary with a new self-titled book, published by Rizzoli. It’s an ode to his outrageous shoes. His next project — a line of red-soled shoes for men, is due out next spring.

This 47-year-old sole man, who practices the trapeze and rides around Paris on a bright red Vespa scooter, can often be found at his atelier, where his famed shoes are designed and handmade. He makes no apologies for those sky-high prices either — Louboutins can sell from $495 and up, with crystal-encrusted pair costing $6,000.

“I would say that a good shoe is exactly like a good wine,” Louboutin said. “These shoes are going to stay and last for a long time.”

While fashion overrides comfort for Louboutin — many of his shoes are seven-inch high heels — the designer says he has a very specific customer in mind when he sketches a shoe.

“It’s sort of you know it’s a sort of expression. I like my customer to be fierce,” he said.

In 2011, Christian Louboutin filed a lawsuit against Yves Saint Laurent, claiming that the design house had infringed on its trademark by selling shoes with red soles.     In September 2012, the court finally ruled that Louboutin retains the exclusive right to use the color red on the bottom of its shoes whenever the outer portion of the shoe is any color besides red, while Yves Saint Laurent can continue to sell its shoes with red soles as long as the whole shoe is red. So while there are other brands out there with shoes sporting red soles, it looks like Louboutins will remain the only ones with that particular combination.

    Europes highest court has backed Christian Louboutin in its battle to protect its distinctive red soles.

    In 2012, Louboutin sued rival firm Van Haren for selling high heeled shoes with scarlet soles.

    Under EU law companies cannot trademark common shapes of products such as the soles of shoes.

    Van Haren argued that applying red to a shoe sole came under that law and, as a result, Louboutin did not have trademark protection.

    However, the European Court of Justice said that shape trademarks do not apply to Louboutins red sole.

    Christian Louboutin first designed his trademark shoe in 1993, using an assistants red nail polish.

    The luxury brand said it warmly welcomes the judgement.

    For 26 years, the red sole has enabled the public to attribute the origin of the shoe to its creator, Christian Louboutin, the brand said in a statement.

    This case will now be referred back to The Hague Court which is expected to confirm the validity of the red sole trademark.

    What Christian Louboutin is most famous for is his iconic red soles, which first appeared in 1993.

    Louboutin came up with the idea after using an assistants red nail polish to paint the soles of a sample to give the shoes extra energy.

    The signature red of Christian Louboutin soles has its own Pantone number, 1801663 TPX. Louboutin has taken on everyone from Zara to Yves Saint Laurent for using red soles on their shoes.

    Frustrated after having tried different things to liven up the design, I spontaneously grabbed my assistants red nail polish and painted the sole. I instantly knew that this would be a success!

    Christian Louboutin discovered his love of high heels in 1976, when he visited a museum in his hometown of Paris. Women with stiletto heels were prohibited from entering certain areas of the exhibition so as not to damage the floor. The then-12-year-old Christian Louboutin wanted women to be able to choose exactly what they wanted to wear, and so he began to draw shoe designs.

    Louboutin landed his first job at the famous Parisian performance hall Folie Bergère as an assistant to the halls show girls. After a few years working there, Louboutin longed for adventure. He began exploring Egypt and India, absorbing all that he saw into his designs. When he returned to Paris in 1981, Louboutin began working as a freelance show designer for for prestigious fashion houses, including Charles Jourdan, Chanel, Yves Saint Laurent and Roger Vivier.

    In 1991, Louboutin finally opened his own boutique in Paris with one of his first prominent clients, Princess Caroline of Monaco. Her adoration for Louboutin paved the way for him to build a clientele of the worlds most well-heeled.

    The Beginning Of The Red Bottom

    The iconic red-lacquered sole has become this brands identity. But how did that red bottom come to be?

    After two years of designing luxury shoes, Louboutin wanted to change the current design.

    He was inspired by Andy Warhols Flowers, but his prototype left him wanting more. Thankfully that day in his studio, an assistant was sitting nearby and painting her nails red.

    There was this big black sole, and then, thank God, there was this girl painting her nails at the time, said Louboutin.

    With a stroke of genius, he decided he would paint the bottom of his shoes red. That simple moment changed the path of his brand forever. The exact color of the Chinese red sole is Pantone 18-1663 TPX.
